Terms of Service LuxHost
Last update: 06.10.2026
These Terms of Service (the "Terms") constitute a public offer by Great Flower, a business registered in Israel under registration number 342667532, with its registered address at Rozmarin 12, Be'er Sheva 8465059, Israel (the "Provider"), operating under the trade name LuxHost, addressed to an unlimited number of persons, and contain all material terms of the agreement for the provision of services (the "Agreement"). By accepting these Terms in the manner described in Section 2, you enter into a binding Agreement with the Provider.
Definitions
1.1. Site — the Provider's website at https://luxhost.cc and its subdomains, including the client area at https://app.luxhost.cc.
1.2. Account (Client Area) — the User's personal section of the Site, accessible after registration, through which Services are ordered, paid for and managed.
1.3. User — a legal entity, or a natural person aged 18 or over acting for purposes of their trade, business or profession, who has accepted these Terms.
1.4. Services — the services offered by the Provider on the Site: (a) registration, renewal and transfer of domain names (the "Domain Services"); (b) provision of virtual private servers (the "VPS"); (c) provision of dedicated servers (the "Dedicated Servers"); (d) ancillary services such as additional IP addresses, DNS hosting and technical support, as listed on the Site.
1.5. Suppliers — third parties whose resources the Provider uses to deliver the Services: ICANN-accredited registrars and ccTLD registrars (each a "Sponsoring Registrar"), domain registries, data-centre and hardware providers, network and payment providers.
1.6. Balance — the prepaid amount recorded in the Account, which the User may apply to pay for Services. The Balance is a prepayment for Services and is not a deposit, electronic money or a payment instrument; it bears no interest and cannot be transferred to another Account or to third parties.
1.7. Billing Period — the period for which a Service is paid in accordance with the selected plan (for example, one month or one year).
1.8. Order — the User's request for a specific Service placed through the Account.
1.9. Privacy Policy and Refund Policy — the documents published on the Site that form an integral part of these Terms.
1.10. Infrastructure — the Provider's servers, network equipment, IP address space (including the Provider's autonomous system) and software used to deliver the Services. The Provider's servers are physically located in data centres in the European Union (currently Germany, Finland and Poland).
Acceptance and Parties
2.1. The Agreement is concluded by the User's acceptance of these Terms. Acceptance is any of the following: ticking the acceptance box at registration or checkout, registering an Account, topping up the Balance or placing an Order. Upon acceptance the Agreement is binding; no signed paper copy is required.
2.2. The Provider records the date, time, IP address and the version of the Terms accepted by each User and may rely on that record as evidence of acceptance.
2.3. Business use. The Services are intended for business and professional use. By accepting these Terms the User represents that they act in the course of their trade, business or profession (or on behalf of a legal entity they are authorised to bind) and not as a consumer. Nothing in these Terms excludes rights that mandatory law grants to a User who nevertheless qualifies as a consumer under the law of their habitual residence; in that case Sections 20.3 and 20.4 apply.
2.4. The Provider may refuse to register an Account or to accept an Order at its discretion, including for reasons of fraud prevention, sanctions compliance or previous breaches, and may require the User to verify their identity, business status or payment method before or after a Service is provided.
2.5. Information provided at registration and in the Account must be accurate and kept up to date. The User may hold one Account unless the Provider agrees otherwise in writing.
2.6. The User may use the Services to provide services to their own customers but remains fully responsible to the Provider for all use of the Services made through the User's Account.
Services, Orders and Provisioning
3.1. The scope, specifications and prices of each Service are set out on the Site at the time of the Order. The Provider delivers Services as described in the plan ordered; all Services are unmanaged unless a managed option is expressly purchased.
3.2. Provisioning. VPS are normally activated automatically within one hour after payment and in any event within 24 hours; Dedicated Servers within the delivery time stated at the time of the Order; Domain Services upon confirmation by the registry. If a VPS is not activated within 24 hours, or a Dedicated Server within 7 business days after the stated delivery time, for reasons attributable to the Provider or its Suppliers, the User may cancel the Order and receive a full refund of the amount paid for it in accordance with the Refund Policy.
3.3. The Provider may perform scheduled maintenance with at least 24 hours' notice through the Site or by email, and emergency maintenance without notice where required to protect the Infrastructure or other users.
3.4. The Provider may change the technical characteristics of the Infrastructure (hardware, software, data centre, Supplier) provided the Service continues to meet the specifications of the plan ordered.
Domain Services
4.1. The Provider acts as a reseller of the Sponsoring Registrar. Each domain name is registered in the name of the User (the registrant); the Provider does not claim ownership of the User's domain names. The identity of the Sponsoring Registrar for a domain name is shown in the Account or provided on request.
4.2. By ordering a Domain Service the User enters into, and agrees to comply with, the registration agreement of the Sponsoring Registrar and the policies of the relevant registry and, for generic top-level domains, of ICANN, including: the Uniform Domain Name Dispute Resolution Policy (UDRP), the Uniform Rapid Suspension procedure (URS), the Transfer Policy, the Transfer Dispute Resolution Policy, the Expired Registration Recovery Policy (ERRP), the registration data policies and the Registrants' Benefits and Responsibilities (https://www.icann.org/resources/pages/benefits-2013-09-16-en). Links to the current registration agreement are provided in the Account.
4.3. Registration data. The User must provide complete and accurate registrant, administrative and technical contact data and update it within 7 days of any change. Inaccurate data, or failure to respond to a verification request within 15 calendar days, may result in suspension of the domain name in accordance with ICANN or registry rules. Registrant data may be published in RDAP/WHOIS services to the extent required by the relevant registry; privacy or proxy services, where available for a domain name, are shown in the Account.
4.4. Renewal and expiry. Domain names are renewed only if the User pays the renewal fee before the expiry date or has enabled automatic renewal and sufficient funds or a stored payment method are available. The Provider sends expiry reminders to the User's email address approximately one month and one week before expiry and within five days after expiry. After expiry a domain name may be renewed during the registrar's grace period at the standard renewal fee and, during the redemption period, at the redemption fee published on the Site; thereafter it is deleted and becomes available to third parties. The Provider is not responsible for the loss of a domain name that the User failed to renew in time.
4.5. Transfers. The User may transfer a domain name to another registrar in accordance with the Transfer Policy. The Provider makes the authorisation (AuthInfo/EPP) code available in the Account or provides it within five calendar days of the User's request and does not unreasonably deny a transfer. Transfers are not possible within 60 days after registration, a previous transfer or a change of registrant where ICANN or registry rules so provide, or while the domain name is subject to a dispute or to unpaid fees.
4.6. Change of Sponsoring Registrar. The Provider may change the Sponsoring Registrar for all or part of the domain names it manages, including by bulk transfer under ICANN procedures; such transfers do not affect the User's registration term. Where a domain name cannot be included in a bulk transfer (for example, certain country-code domains) and must be transferred individually, the Provider notifies the User and may charge the transfer fee shown in the Account; the User may instead transfer the domain name to a registrar of their choice.
4.7. Country-code domains. Country-code domain names are subject to the rules of the relevant national registry, which may impose eligibility, local-presence or documentation requirements and may not allow cancellation or refunds.
4.8. Domain fees are non-refundable once the registration, renewal or transfer has been submitted to the registry, except as provided in the Refund Policy.
VPS and Dedicated Servers
5.1. VPS are provided as virtualised resources (vCPU, RAM, storage, traffic allowance and IP addresses) according to the selected plan. Dedicated Servers are provided as physical servers with the configuration stated in the Order, with out-of-band (IPMI/KVM) access where included in the plan.
5.2. Traffic and fair use. Each plan includes the traffic allowance (volume and/or bandwidth) stated on the Site. Once the allowance is exhausted the Provider may reduce bandwidth (traffic shaping) or charge overage at the rates shown on the Site, as stated in the plan. Plans described as "unlimited" are subject to fair use: sustained use that materially exceeds the typical use of the plan, or degrades the Infrastructure for other users, may be shaped or may require an upgrade.
5.3. IP addresses. IP addresses are allocated to the User for the duration of the Service, remain the property of or under the control of the Provider and may be changed by the Provider for technical, legal or reputational reasons, with reasonable notice where practicable. The User acquires no right to any IP address. IP addresses that are blacklisted as a result of the User's activity may be replaced at the User's expense at the fee shown on the Site.
5.4. Backups. The Provider does not back up the User's data unless a backup service is expressly included in the plan. The User is solely responsible for backing up their data and configurations.
5.5. Administration. The User has administrative (root) access and is solely responsible for the operating system, software, security updates, configuration and content of their server. The Provider's support covers the Infrastructure (hardware, network, virtualisation, control panel) and does not include administration of the User's server unless a managed service is purchased.
5.6. Hardware. In the event of a hardware failure of a Dedicated Server the Provider replaces the failed component or the server as soon as reasonably possible; the User is responsible for restoring their data and software from their own backups. Setup fees for Dedicated Servers are non-refundable.
5.7. Software licences. Operating systems, control panels and other software made available by the Provider are licensed under their respective licence terms, which the User must comply with.
5.8. Monitoring. The Provider monitors the operation of the Infrastructure (resource consumption, traffic volume and patterns, network flows) for billing, capacity planning, security and abuse prevention. The Provider does not access the content of the User's server except as provided in Section 11.
Acceptable Use
6.1. The User must use the Services only for lawful purposes and in compliance with the law of Israel, the law of the country where the server is located (Germany, Finland or Poland, as applicable), the law of the User's own country and these Terms.
6.2. The following are prohibited:
sending spam, phishing or other unsolicited bulk messages, or hosting content advertised by such messages; operating open mail relays, open DNS resolvers or unauthenticated open proxies;
child sexual abuse material and any content that sexualises minors; content inciting terrorism or violence; content that is illegal under the law of Israel or of the country where the server is located;
malware, botnets, command-and-control infrastructure, exploit kits, credential-stuffing tools and other tools designed to compromise third-party systems;
denial-of-service attacks, port or vulnerability scanning of third-party systems without authorisation, unauthorised access to third-party systems, IP spoofing;
infringement of intellectual property rights, including unauthorised distribution of copyrighted works;
fraud, including carding, payment fraud, fake shops and identity theft; sale of counterfeit goods; activities whose purpose is to evade sanctions;
cryptocurrency mining on VPS; on Dedicated Servers mining is permitted only with the Provider's prior written consent and within the power and thermal limits of the server;
any activity that causes the Provider's IP addresses or network to be blacklisted, or that disrupts the Infrastructure or other users;
circumventing the Provider's billing, limits or security measures; sharing or reselling a Service in a manner that violates these Terms.
6.3. Abuse handling. The User must keep a working contact email address for abuse notices and respond to abuse notices forwarded by the Provider within 24 hours, taking the actions necessary to stop the abuse. The Provider may charge a handling fee of USD 25 for each justified abuse complaint beyond the first in a calendar month, and the actual costs of blacklist removal, IP replacement or legal correspondence caused by the User. The handling fee compensates the processing of the complaint; its payment is not a condition of, and does not entitle the User to, reinstatement of a suspended Service.
6.4. Technical measures. To protect the Infrastructure and other users the Provider may apply proportionate technical measures, including rate limiting, traffic filtering, null-routing of IP addresses, blocking of ports, additional authentication and temporary restriction of access. Such measures do not constitute a breach of the Agreement where they are proportionate to the identified risk.
6.5. Suspension and termination for breach. In the event of a material breach of this Section 6, in particular of items (a) to (f) of Section 6.2, or of an immediate risk to the Infrastructure, the Provider may suspend or terminate the affected Service immediately and without refund of the unused Billing Period. In other cases of breach the Provider notifies the User and allows a reasonable period, not less than 24 hours, to remedy the breach before suspension. The Provider informs the User of the reasons for the measure in accordance with Section 7.4. A Service suspended under this Section is reinstated only after the User has demonstrated, to the Provider's reasonable satisfaction, that the cause of the breach has been removed (for example, by reinstalling or cleaning a compromised server, changing credentials, or providing written authorisation for security testing); a promise alone is not sufficient. A repeated breach of the same kind within 30 days of reinstatement results in termination of the Service without reinstatement and without refund.
6.6. The User is responsible for the acts and omissions of all persons who use the Services through the User's Account, including the User's own customers.
Content, Notices and the EU Digital Services Act
7.1. In respect of servers located in the European Union the Provider is a hosting service provider within the meaning of Regulation (EU) 2022/2065 (Digital Services Act, "DSA"). The Provider does not pre-screen content stored by Users and has no general obligation to monitor it.
7.2. Point of contact. The Provider's single point of contact for the authorities of EU Member States, the European Commission and the European Board for Digital Services (Article 11 DSA) and for recipients of the service (Article 12 DSA) is abuse@luxhost.cc. Communication may be conducted in English or Russian.
7.3. Notice and action. Any person or entity may notify the Provider of content they consider illegal by email to abuse@luxhost.cc, stating: (a) a sufficiently substantiated explanation of why the content is illegal; (b) the exact location of the content (URL or IP address and, where relevant, additional identifiers); (c) the notifier's name and email address, except for notices concerning child sexual abuse material; and (d) a statement that the notice is accurate and complete and made in good faith. The Provider processes notices diligently, in a non-arbitrary and objective manner, primarily by human review, and informs the notifier of its decision without undue delay.
7.4. Statement of reasons. Where the Provider removes or disables access to content, suspends or terminates a Service, or otherwise restricts the User on the ground of illegality or breach of these Terms, it informs the User of the measure, its reasons, the facts and circumstances relied on, whether the decision was based on a notice or on the Provider's own initiative, and the means of redress available (a complaint through the ticket system and, where applicable, judicial redress), except where it is prevented from doing so by law or by a request of a competent authority.
7.5. Orders of authorities. The Provider complies with orders of competent judicial and administrative authorities to act against illegal content or to provide information, in accordance with Articles 9 and 10 DSA and other applicable law, and informs the User where permitted.
7.6. The Provider may remove or disable access to content and suspend Services where required by law or by an order of a competent authority, or where the Provider becomes aware of manifestly illegal content.
Fees, Taxes and Payment
8.1. Prices are published on the Site in US dollars (USD) and apply as at the time of the Order. The Provider may display prices in other currencies for convenience; the amount charged is calculated at the rate indicated at checkout.
8.2. Taxes. Prices exclude value added tax and similar taxes unless stated otherwise. Where the Provider is required by law to charge VAT, including Israeli VAT for Users resident in Israel and EU VAT for Users in the European Union who do not provide a valid VAT identification number, the tax is added at checkout. Business Users in the EU must enter their VAT identification number in the Account; where the reverse-charge mechanism applies, the User is responsible for accounting for VAT.
8.3. Prepayment. Services are provided on 100% prepayment. The User tops up the Balance, and the price of each Service is debited from the Balance at the start of each Billing Period. Payment is deemed made when the funds are credited to the Balance.
8.4. Payment methods are listed on the Site and may include bank cards and cryptocurrency through third-party payment providers. The Provider does not receive or store full card numbers. All fees of banks, payment providers and blockchain networks are borne by the User; cryptocurrency top-ups are credited in the amount actually received after network fees.
8.5. Invoices and receipts are issued electronically and are available in the Account.
8.6. Promotional prices. Prices marked as promotional, introductory or "first period" apply to the first Billing Period only; renewals are charged at the regular price displayed in the Account at the time of the Order and in the renewal notice. The Provider indicates the regular renewal price before the User confirms the Order.
8.7. Price changes. The Provider may change prices with at least 14 days' notice through the Site or by email. Price changes do not apply to Billing Periods already paid for. Changes in Supplier, registry or tax charges that the Provider is required to pass on may be applied from the date they take effect, with notice.
8.8. Chargebacks. Before disputing a payment with a card issuer or payment provider the User must submit a claim to the Provider under Section 17. A chargeback filed without first contacting the Provider, or for a Service that has been delivered, is a breach of the Agreement; the Provider may suspend the Account until the dispute is resolved, charge a chargeback handling fee of USD 25 per disputed transaction and recover any amounts owed.
8.9. Fraud. If a payment is identified as fraudulent, including the use of a stolen card or wallet, the Provider may cancel the Services paid for with it and close the Account.
Stored Payment Methods and Automatic Renewal
9.1. The User may save a bank card or another supported payment method in the Account. Card details are stored by the Provider's payment provider in tokenised form; the Provider stores only the card brand, the last four digits and the expiry date.
9.2. Authorisation. By saving a payment method and enabling automatic renewal or automatic top-up, the User authorises the Provider to charge the stored payment method, without further action by the User: (a) for the renewal of each Service for which automatic renewal is enabled, in the amount of the regular renewal price in force for that Service and plan, at the frequency of its Billing Period; and (b) where automatic top-up is enabled, for the top-up amount selected by the User whenever the Balance falls below the threshold selected by the User.
9.3. Disclosure and reminders. When the User enables automatic renewal, the Provider confirms by email the Service, the amount, the frequency and the way to cancel. The Provider sends a reminder by email at least 7 days before each renewal charge for Billing Periods of one month or longer, and a receipt after each charge.
9.4. Timing. The renewal charge is attempted on the last day of the current Billing Period, or on an earlier date not more than 3 days before it as shown in the Account. If the charge fails the Provider may retry up to 3 times within the following 3 days; if the charge is not successful, the Service is renewed only if the User pays by other means, failing which Section 10 applies.
9.5. Cancellation. The User may disable automatic renewal or automatic top-up, or remove a stored payment method, at any time in the Account or by contacting support; the change takes effect for charges not yet initiated. Disabling automatic renewal does not entitle the User to a refund of the current Billing Period.
9.6. Price changes for automatically renewing Services are notified in accordance with Section 8.7 before they are charged; the User may disable automatic renewal before the change takes effect.
Term of Services, Non-payment, Suspension and Deletion of Data
10.1. Each Service is provided for the Billing Period paid for and renews only upon payment, manual or automatic, for the next Billing Period.
10.2. If a VPS or Dedicated Server is not renewed by the end of its Billing Period, the Provider suspends it. After suspension the User's data is retained, and the Service can be reactivated by payment, for the following periods: Linux VPS, 7 calendar days; Windows VPS, until the weekly deletion run, which takes place on Mondays, so that the server is deleted on the first Monday after the day of suspension (between 1 and 7 days later); Dedicated Servers, 3 calendar days. Thereafter the server is deleted and the data is irreversibly erased. Domain names are governed by Section 4.4.
10.3. On termination of a Service or of the Agreement for any reason the Provider deletes the User's data on the server within the periods in Section 10.2 and is not obliged to retain or return it. The User must export their data before termination.
10.4. The Provider may suspend Services where the User fails to respond to a verification request under Section 2.4, in the circumstances described in Sections 6, 7 and 8.8, or where required by law or by an order of a competent authority.
Data, Confidentiality and Access to Servers
11.1. The data stored by the User on the Services belongs to the User. The Provider does not access the content of the User's servers except: (a) at the User's request for support; (b) to the extent necessary to investigate or stop a breach of Section 6 or a security incident; (c) where required by law or by an order of a competent authority. Any such access is limited to what is necessary.
11.2. The User is responsible for the lawfulness of the data they store, including personal data of third parties. Where the User processes personal data of individuals in the European Economic Area on the Services, the Provider acts as a processor of that data to the extent of its storage and transmission, and a data processing agreement in accordance with Article 28 GDPR is available on request.
11.3. The processing of the User's own personal data by the Provider is governed by the Privacy Policy.
Service Levels
12.1. The Provider targets 99.5% monthly availability of the network and of the virtualisation platform, excluding scheduled maintenance, circumstances under Section 15 and causes attributable to the User. This target describes the quality the Provider aims for and is not a guarantee; the Provider does not offer service credits unless agreed in writing for a specific Service.
12.2. The Provider does not guarantee uninterrupted or error-free operation of Supplier systems, registries or the internet, nor that the Services will be suitable for any particular purpose of the User.
Intellectual Property
13.1. The Site, the Account, the Provider's software and trade names are the property of the Provider or its licensors. The User receives a non-exclusive, non-transferable right to use them for the purpose of receiving the Services.
13.2. The User retains all rights in their content and grants the Provider the technical right to store, copy and transmit it to the extent necessary to provide the Services.
Liability and Indemnity
14.1. The Provider is liable for the organisation and provision of the Services in accordance with these Terms. The Provider is not liable for interruptions caused by Suppliers, registries, network operators or third-party attacks where the Provider has taken reasonable steps to prevent or remedy them.
14.2. The Provider is not liable for loss of profit, loss of business, loss of data (subject to Section 5.4) or indirect or consequential loss.
14.3. The Provider's total liability under or in connection with the Agreement, per event or series of related events, is limited to the fees paid by the User for the affected Service in the 12 months preceding the event.
14.4. The limitations in this Section do not apply to liability for wilful misconduct or gross negligence of the Provider, for death or personal injury, or to any liability that cannot be limited under applicable law.
14.5. The User indemnifies the Provider against claims, fines, penalties and costs (including reasonable legal costs) brought against the Provider by third parties or authorities as a result of the User's content, the User's use of the Services or a breach of these Terms.
Force Majeure
15.1. Neither party is liable for failure to perform caused by circumstances beyond its reasonable control, including natural disasters, war or armed conflict, acts of authorities, large-scale failures of power supply or telecommunications networks and large-scale cyber-attacks. The affected party notifies the other within 5 business days. If such circumstances continue for more than 30 days, either party may terminate the affected Service, and the unused portion of the prepaid fees is refunded to the Balance.
Changes to the Terms
16.1. The Provider may amend these Terms, the Privacy Policy and the Refund Policy. Material amendments are notified at least 14 days before they take effect by email to the Account address and by publication on the Site; the current version and its effective date are always available on the Site. Amendments required by law, by a Supplier or by a registry, and amendments that do not reduce the User's rights, may take effect on publication.
16.2. Continued use of the Services after the amendments take effect constitutes acceptance of them. A User who does not agree may terminate the Agreement under Section 18 before the effective date; in that case the Provider refunds the unused portion of the prepaid fees for the Services affected by the amendment to the Balance or, for card payments, to the original payment method.
Support and Complaints
17.1. Technical and information support is provided through the ticket system at https://app.luxhost.cc/support and the Telegram bot at https://t.me/LuxHostSupport_bot. The target time for a first response is 24 hours.
17.2. Claims concerning the quality of the Services or payments are submitted through the ticket system. The Provider responds within 30 calendar days. Submitting a claim is a condition precedent to court proceedings and to disputing a payment with a payment provider.
17.3. The Provider may decline to respond to messages containing insults, threats or demands to perform unlawful acts.
Term and Termination
18.1. The Agreement enters into force upon acceptance and remains in force until terminated.
18.2. The User may terminate the Agreement at any time by requesting closure of the Account through the ticket system, and may cancel any individual Service in the Account. Termination does not entitle the User to a refund of fees for the current Billing Period except as provided in the Refund Policy and in Section 16.2.
18.3. The Provider may terminate the Agreement or any Service: (a) without cause, with 30 days' notice, in which case the unused portion of the prepaid fees for the terminated Service is refunded to the Balance or, at the User's request for card payments, to the original payment method; (b) immediately in the cases set out in Sections 6.5, 8.9 and 10.4, where the User becomes subject to sanctions, or where continued provision would be unlawful. In the cases under (b) the unused Balance is dealt with in accordance with Section 3.7 of the Refund Policy.
18.4. Sections 11, 13, 14, 17 and 20, and any other provisions that by their nature are intended to survive, survive termination.
Sanctions and Export Control
19.1. The User represents that they are not located or established in, and will not use the Services for the benefit of persons in, a country or territory subject to comprehensive sanctions of the United Nations, the European Union, the United States or Israel, and that they are not listed on a sanctions list maintained by those authorities. The Provider may refuse, suspend or terminate Services to comply with sanctions and export-control laws.
Governing Law and Disputes
20.1. These Terms and the Agreement are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules.
20.2. Any dispute that is not resolved under Section 17 is submitted to the exclusive jurisdiction of the competent courts of Be'er Sheva, Israel.
20.3. Where the User qualifies as a consumer under the mandatory law of the country of their habitual residence, nothing in these Terms deprives the User of the protection of provisions of that law that cannot be derogated from by agreement, and the User may also bring proceedings before the courts of that country.
20.4. The Provider does not participate in alternative dispute resolution procedures before consumer arbitration bodies unless required by law.
Notices
21.1. The Provider sends notices to the email address registered in the Account; a notice is deemed received on the business day following dispatch. The User sends notices to the Provider through the ticket system or to the email addresses in Section 23. The User must keep their email address up to date.
Miscellaneous
22.1. Entire agreement. These Terms, the Privacy Policy, the Refund Policy, the plan description in the Order and any written special terms constitute the entire agreement between the parties. In the event of conflict, special terms prevail over these Terms, and the Refund Policy prevails on matters of refunds.
22.2. Assignment. The Provider may assign the Agreement, in whole or in part, to a successor of its business or to an affiliated entity, with notice to the User and without reduction of the User's rights. The User may not assign the Agreement without the Provider's written consent.
22.3. Severability. If a provision is held invalid, the remaining provisions remain in force, and the invalid provision is replaced by a valid provision that most closely reflects its purpose.
22.4. No waiver. Failure to enforce a provision is not a waiver of it.
22.5. Language. These Terms are drawn up in English. Translations are provided for convenience; in the event of a discrepancy the English version prevails.
